California Addendum

This Addendum supplements Macquarie’s Global Privacy policy and applies to all California resident prospective employees, employees, and independent contractors. Except as noted below, nothing in this Addendum changes or modifies any of the policies or procedures set forth in Macquarie’s policies and procedures.

California resident prospective employees, employees, and independent contractors have certain additional rights over the employment-related personal information (“PI”) that Macquarie collects.  This California Privacy Policy Addendum describes the personal information that Macquarie (collectively, “Macquarie,” “we,” “us,” and “our”) collects about prospective employees, employees, and independent contractors, the rights you have with respect to that information, and how you can exercise those rights.

The following table lists the categories of California Personal Information we may have collected about prospective employees, employees, and independent contractors in the last 12 months, the categories of sources from which we have collected it, and how we will use the information.

Professional or employment-related information, such as references from previous employers, whether you have ever been sanctioned by a professional body, whether you are subject to any restrictive covenants, assessment results to measure your preferred working styles and aptitudes and information from your public social media accounts (such as LinkedIn, etc.).

If you are a registered representative in the securities industry:
  • Uniform Application for Securities Industry Registration or Transfer (Form U4);
  • Uniform Termination Notice for Securities Individuals (Form U5);
  • Records from the Central Registration Depository (CRD) and FINRA's "Broker Check;
  • Information collected by FINRA as part of its background check, including a description of physical characteristics, customer complaints and outcome;
  • Information that you provide to us as required by the securities industry;
  • Information from federal and state licensing organizations.

Categories of personal information we have sold or shared in the last 12 months

We do not sell or share any California PI we collect from prospective employees, employees, or independent contractors in those roles. 

If you have visited our public website, we have shared your IP address, the URL you came from, and your interaction with the website with analytics providers for their use in cross-context behavioral advertising across multiple websites. Consumers under the age of 16

We do not have actual knowledge that we sell or share the personal information of minors under 16 years of age.

 

Personal information disclosed for a business purpose

In the preceding twelve (12) months, we may have disclosed the following categories of personal information to our affiliates, service providers and/or third parties to whom you or your agents have authorized us to disclose your personal information:

  • We may have disclosed your identifiers and Internet or other similar network activity (anonymised where possible);
  • We may have disclosed your educational information, professional or employment-related information, and medical information;
  • We may have disclosed any other personal information on a confidential basis;
  • We may have disclosed aggregated and anonymised diversity data.

Business Purposes

  • To allow our external service providers to process data on our behalf and provide services to us, such as our payroll service providers, insurers, and other benefit providers (such as retirement, superannuation or pension plan administrators) and related advisers; and our bank and organisations that host our IT systems and data;
  • To allow our external service providers such as insurers, brokers, bankers, medical practitioners, benefit scheme managers and other service providers who may be providing operational, recruitment, training, employment screening, administrative, telecommunication, processing or human resources services or support to Macquarie;
  • To allow clients or potential clients of Macquarie to engage Macquarie for services on their behalf;
  • For the purpose of external email recipients performing services on behalf of Macquarie;
  • To a potential buyer of any part of our business or company for the purposes of evaluation – but only if we were to contemplate selling;
  • To law enforcement agencies, in order to respond to requests or where required by applicable laws, pursuant to court orders, or arbitral or tribunal orders or rules of procedure, or to government departments or agencies (including disclosures to tax and employment authorities), or any other regulatory bodies;
  • To our advisers – for example, to our lawyers for the purposes of seeking legal advice or to further Macquarie’s interests in legal proceedings or to our accountants for auditing purposes
  • To relevant regulators as part of a formal request;
  • To our service providers for the purpose of debugging, ensuring the security and integrity of our systems, and assessing efficiency of IT or business system device usage.

 

Sensitive personal information

We do not use or disclose sensitive personal information for any purpose other than as permitted by the California Privacy Rights Act. 

 

Your rights

  • The right to know. You have the right to know what personal information we collect about you, including the categories of personal information collected, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling or sharing personal information, the categories of third parties to whom we disclose personal information, and the specific pieces of personal information  that we have collected about you. 
  • The right to delete. You have the right to delete personal information that we have collected from you, subject to certain exceptions.
  • The right to correct. You have the right to correct inaccurate personal information that we maintain about you.
  • The right to opt-out. If a business sells or shares your personal information to third parties, you have the right to opt-out of the sale or sharing of your California Personal Information. You can visit our Notice of Right to Out-Out of Sale or Sharing here.
  • The right to limit use of sensitive personal information. If a business uses or discloses sensitive personal information for reasons other than those permitted by the California Privacy Rights Act, you have the right to limit the use or disclosure of sensitive personal information. We do not use or disclose sensitive personal information for any purpose other than as permitted by the California Privacy Rights Act. 
  • The right not to receive discriminatory treatment. You have the right not to receive discriminatory treatment by us for the exercise of privacy rights conferred by the California Privacy Rights Act, including the right not to be retaliated against for the exercise of your privacy rights.

 

How you can exercise your rights

To exercise your privacy rights, call us at 212-231-1778 or please e-mail hrservicedesk@macquarie.com.   

We will confirm receipt of your request.  We will acknowledge receipt of your request within 10 business days. 

We will verify your identity. We will match pieces of personal information provided by you with personal information maintained by us that we have determined are reliable. We may also require that you submit a signed declaration under penalty of perjury stating that you are the individual whose personal information is the subject of the request. Our verification process will vary depending on the nature of your request and the sensitivity of the information. 

We will respond. We will respond to your request no later than 45 calendar days after we receive the request. If we cannot respond to your request within that time, we may notify you that we may take up to an additional 45 calendar days to respond, and we will explain why we need additional time. 

You may designate an authorized agent to submit a request on your behalf. You may authorize another person to submit a request to know, delete or correct your personal information. To have another person submit a request on your behalf, call us at 212-231-1778 or contact us by e-mail to hrservicedesk@macquarie.com  and tell us that you would like to authorize another person to submit a consumer privacy request on your behalf. 

 

How we process opt-out preference signals

An opt-out preference signal is a signal that is sent by a platform or browser that clearly communicates your choice to opt-out of the sale and sharing of personal information. We process opt-out preference signals in a frictionless manner. You can implement an opt-out preference signal through the privacy controls available on your web browser, or by downloading a browser extension that can be enabled to support your single opt-out preference signal. Your opt-out preference signal will apply to your browser.
